    1. Definitions & Scope

    Lumina Journeys ("Company", "we", "us") operates as a travel planning, advisory, and booking facilitation service. These Terms & Conditions ("Terms") constitute a legally binding agreement between the Company and any individual or entity ("Client", "you") using our services, website (luminajourneys.in), or communicating with us via any channel including WhatsApp, email, phone, or social media. By engaging with our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must discontinue use of our services immediately.

    2. Nature of Services

    The Company acts exclusively as an intermediary and facilitator between Clients and third-party service providers including but not limited to airlines, hotels, resorts, cruise lines, tour operators, ground transportation providers, visa processing agencies, and travel insurance companies ("Service Providers"). The Company does not own, operate, manage, or control any of these Service Providers. All travel services, accommodations, transportation, and related products are provided solely by their respective Service Providers. The Company's role is limited to advising, planning, coordinating, and facilitating bookings on behalf of the Client. The Company does not guarantee the performance, quality, safety, or availability of any Service Provider's offerings.

    3. Booking & Payment

    All bookings are considered confirmed only upon receipt of the required deposit or full payment as communicated at the time of quotation. Payment may be made via bank transfer, UPI, or credit/debit card. A booking confirmation will be issued upon successful payment. All quoted prices are subject to change without notice until a booking is confirmed and payment is received. Prices displayed on our website are indicative starting prices per person on twin-sharing basis and are subject to availability, travel dates, seasonal demand, currency fluctuations, and the specific requirements of each booking. Final pricing will be communicated after detailed consultation and is binding only upon written confirmation by both parties. The Client acknowledges that price increases may occur due to factors beyond the Company's control, including but not limited to fuel surcharges, tax changes, currency fluctuations, and Service Provider pricing changes.

    4. Cancellation, Amendments & Refunds

    Cancellation and amendment policies are determined entirely by the respective Service Providers involved in each booking, including airlines, hotels, cruise lines, tour operators, and other vendors. The Company will communicate all applicable cancellation and amendment terms, timelines, and charges specific to your booking before confirmation. Cancellation charges vary significantly based on the type of service, the specific Service Provider's policies, the proximity to the travel date, and the fare/rate class booked. The Company does not set, control, or have discretion over cancellation charges imposed by Service Providers. Any processing fees charged by the Company for handling cancellations or amendments will be communicated in advance. Our own service fees, planning sessions and digital products are covered by our Cancellation & Refund Policy. Refunds, where applicable per Service Provider policies, will be processed after the Company receives the refund from the respective Service Provider. Processing timelines for refunds are dependent on the Service Provider and banking channels and typically range from 15 to 60 business days. The Company strongly recommends comprehensive travel insurance to mitigate financial losses from cancellations.

    5. Travel Documents, Visas & Immigration

    It is the sole responsibility of the Client to ensure possession of a valid passport with a minimum of 6 months validity from the date of return travel, along with adequate blank pages for visa stamps. While the Company provides visa application assistance, the granting, denial, or delay of any visa is at the absolute and sole discretion of the respective embassy, consulate, or immigration authority. The Company bears no liability whatsoever for visa rejections, delays, or any consequences arising therefrom, including but not limited to non-refundable booking costs. The Client is solely responsible for ensuring compliance with all entry, exit, health, customs, and immigration requirements of all countries on their itinerary, including transit countries. The Company provides guidance on a best-effort basis but does not warrant the accuracy or completeness of immigration-related advice.

    6. Travel Insurance

    The Company strongly recommends that all Clients purchase comprehensive travel insurance covering, at minimum, medical emergencies, trip cancellation/interruption, lost or delayed baggage, and personal liability. While the Company can facilitate travel insurance through partner providers, the insurance policy is a contract solely between the Client and the insurance company. The Company assumes no liability for any claims, disputes, denials, or issues arising from insurance coverage or the lack thereof. Clients who choose to travel without adequate insurance do so entirely at their own risk.

    7. Hotel Benefits & VIP Perks

    VIP hotel benefits mentioned on our website and communications (including but not limited to complimentary breakfast, hotel credits, room upgrades, early check-in, late check-out, and welcome amenities) are provided through the Company's partnerships with hotel chains and are offered on a best-effort basis. All such benefits are subject to availability at the property level at the time of check-in and may vary by property, room type, season, and occupancy. Room upgrades are never guaranteed and are always at the sole discretion of the hotel property. The Company does not warrant or guarantee the provision of any specific benefit. Specific benefits applicable to each booking will be confirmed at the time of reservation. Terms and conditions of the respective hotel loyalty and partnership programs apply.

    8. Limitation of Liability

    The Company's aggregate liability to the Client, regardless of the form of action, shall in no event exceed the total service fees (excluding third-party costs) actually paid by the Client to the Company for the specific service giving rise to the claim. The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of enjoyment, emotional distress, or any damages arising from the acts, omissions, errors, negligence, bankruptcy, or defaults of any Service Provider. The Company is not liable for any loss, damage, injury, illness, delay, or inconvenience caused directly or indirectly by: (a) the acts, omissions, or defaults of any Service Provider; (b) force majeure events including natural disasters, pandemics, epidemics, acts of God, war, terrorism, civil unrest, government actions, strikes, or any circumstances beyond the Company's reasonable control; (c) the Client's failure to follow the Company's advice or to comply with applicable laws, regulations, and travel requirements; (d) the Client's personal health conditions; or (e) any third party's actions or omissions.

    9. Indemnification

    The Client agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) the Client's breach of these Terms; (b) the Client's violation of any applicable law or regulation; (c) any dispute between the Client and a Service Provider; or (d) the Client's negligent or wrongful actions during travel.

    10. Data Privacy & Communications

    How we collect, use and protect your personal data is set out in our Privacy Policy, and how we use cookies in our Cookie Policy. In short: The Company collects and processes personal information solely for facilitating travel bookings and providing requested services. Client information is shared with relevant Service Providers only as necessary to deliver the services requested. The Company does not sell, trade, or share personal data with unrelated third parties for marketing purposes without explicit consent. By providing contact details, the Client consents to receiving booking-related communications via WhatsApp, email, SMS, and phone. The Client may opt out of promotional communications at any time by contacting the Company.

    11. Intellectual Property

    All content on the Company's website and marketing materials, including but not limited to text, graphics, logos, images, designs, and software, is the property of the Company and is protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or modification of any content is prohibited without the Company's prior written consent.

    12. Dispute Resolution & Governing Law

    Any dispute arising from or related to these Terms or the Company's services shall first be attempted to be resolved amicably through direct negotiation within 30 days of written notice. If amicable resolution fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be in India. These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The Client consents to the exclusive jurisdiction of the courts in India for any matters not subject to arbitration.

    13. Severability & Entire Agreement

    If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with any booking confirmations and quotations provided by the Company, constitute the entire agreement between the parties and supersede all prior or contemporaneous agreements, representations, and understandings.

    14. Modifications

    The Company may update these Terms from time to time. Changes will be shown on this page with an updated revision date and apply to bookings made after that date. Bookings already confirmed stay under the Terms that applied when they were confirmed.
